Terms of use of Cope

Cope's website, apps and the services you can order through cope.no (the "Service") are provided by Coperiosenteret AS, org. 985 311 013, Olav Tryggvasons gate 24, 7011 Trondheim, tel .: +47 95090383, referred to as "Cope" or "vi". The user of the Service is hereinafter referred to as "User" or "you". By using the Service and/or by purchasing products through the Service, you automatically accept these terms. By downloading the Cope app from the App Store or Google Play, you also agree to the terms of the App Store or Google Play. By completing the payment via Vipps you agree to the terms of Vipps AS. For information about processing your health and personal information in our Service, see our Privacy Statement further down below. For more information about the terms of either Vipps AS, Google Play or the App Store, we refer to their respective websites.

Information about the Service

Cope has developed the Service to make psychological health care and/or expert advice more easily accessible to everyone. This is done by providing a secure platform for digital contact with authorized psychologists and experts in mental and physical well-being. In addition, the platform contains information on various topics, written with the aim of increasing the understanding of mental disorders and challenges encountered in everyday life.

Through the Service, you can book two types of digital treatment hours with authorized psychologists or experts, 1) Psychological therapy sessions ("Therapy sessions") and 2) so-called "Drop-in hours".

Through Therapy sessions, you can engage in digital therapy that are equivalent to regular offline therapy sessions with an authorized psychologist. Through Drop-in hours you can book and digital meetings with either psychologists or experts.

The service is not intended for emergency medical or psychological emergencies. If an emergency arises that needs help from health professionals: call emergency services on 113 in Norway or 112 in Europe, or otherwise the emergency number in the country where you currently are.

Accountability for the Service

By using Cope's service, the User understands and agrees that the Service is available "as is" and "as it appears" basis. Cope assumes no responsibility for legal or financial events or results related to any products or services obtained through use of the Service.

Cope assumes no responsibility for content published by the User in the Service. The User is therefore responsible for information provided to the Service, including during Processing Hours (s)

Cope assumes no liability for the Service being unavailable due to problems or errors related to the User's hardware, equipment, network, software or problems or errors in any third-party software. Cope also assumes no responsibility for other circumstances for which the User is responsible under these Terms, and for security attacks that occur despite Cope having established special security measures to prevent viruses or hacking. Cope accepts no responsibility for circumstances beyond Cope's control (force majeure).

Cope is responsible for the content of the website and the app. Psychologists and subject matter experts who provide the treatment hours have a legal and personal responsibility for the treatments to satisfy the requirements for professional responsibility.

Cope is also responsible for arranging for psychologists to comply with all obligations under Norwegian law, including by providing access to the medical record system 'Psykbase'.

Basic Requirements for Users

You must have Norwegian BankID to order and complete the Therapy sessions, so that Cope’s psychologists can identify you in the journal entries. You do not need to identify yourself through BankID if you order Drop-in hours. You can be anonymous by using the reference code you receive after ordering. It is not possible for us to track your reference code to your personal information, but it will be temporarily stored as 'cookie' on your browser in order to show you the right information. The reference code should only be used to verify that you have paid for one Drop-in session with the Cope application. You are responsible for adding the reference code in our application to your account. It is recommended to enter the reference code in the Cope app immediately after your order has been approved, the app will save it after entering.

To order and complete all types of video lessons of the Service, you must be at least 16 years of age. Persons who have not reached the age of 16 can only use the Service through a parent's or guardian's account. In that case, the respective parent’s or legal guardian’s account is used by Cope's staff to engage in sessions with the person under 16. When it comes to Therapy sessions, the psychologist must create a separate journal entry (Psykbase) for the person the session is provided for.

You are responsible for ensuring that the information you have provided to your account in the Service is always accurate and up to date. You are responsible for contacting us in case of any errors while updating your information yourself. A user account is personal and you are responsible for keeping your login information secret and for making sure that your account is not used by anyone else, unless you allow your children - who have not reached the age of 16 - to use your account.

In order to conduct digital video sessions, you must have access to the internet and sufficient network capacity to transmit the data required to stream these sessions. If not, you might experience poor sound and/or video quality during the digital meetings. This may mean that the digital meeting cannot be conducted.

Denied use to the Service

Abuse of the Service is not permitted. This means, among other things, that you cannot utilize the Service for commercial or personal purposes, prevent or interfere with the Service, use the Service to spread any code (e.g. virus), obtain access to the Service using methods not covered by the user interface and the instructions for using the Service, contact Cope employees through private channels, exhibit scandalous, discriminatory or otherwise unfriendly behavior when using the Services, filming digital meetings or in any way contributing to the dissemination of such information, using information obtained through the Research Service without our express permission or exploitation of the Service in conflict with the law.

Abuse or suspicion of misuse of the Service as described above may result in the suspension and/or removal of your account, and possibly legal action. Upon deleting a user account, your personal information will still be stored in our patient record (PsykBase) if you have received Therapy sessions earlier, as demanded by law. Nevertheless, you still have all the rights as described in Norwegian health and privacy legislation.

If you have had your account deleted under due to the abovementioned breaches of these user terms, you will not be able to create a new account without the explicit approval of Cope's top management. If abuse or other breach of these terms has resulted in a financial loss to Cope or its employees, Cope may require that the loss be reimbursed.

Rights to the Services

The User does not acquire any ownership of any intellectual property rights in the Service or the content you access. You may use content from the Service only with the express permission of Cope. These terms do not entitle you to use any trademarks or logos contained in the Service.

Prices and payment

It costs NOK 1050 for a session of 45 minutes at Cope. This price includes all fees and charges for using the service. In order to use some functionalities of  the Service, you have to download a Cope app, this is always free.

Furthermore, we note that the use of the Service requires internet access, which may be subject to additional fees from an external operator.

When ordering a Therapy sessions, the relevant amount will be reserved through Vipps payment service. Users cannot start the hour until the corresponding payment is reserved. The agreement is binding on both parties once the buyer has sent their order to the seller and the amount has been reserved.

The agreement is not binding if any typing or typing errors have occurred in the offer on Cope's website. In the event of errors during the payment process, both Cope and the User have the right to be reimbursed for the missing amount. Please contact hei@cope.no as soon as possible if you notice any errors during or after the payment process. Vipps AS is responsible for all payment processes, while Cope is responsible for showing the correct content on the website and app.

Cancellation

Cancellation or rescheduling of Therapy sessions can be done free of charge 24 hours before the session is held. When a notice of cancellation or rescheduling is given less than 24 hours until the start of the respective Therapy session, the session price will be charged in full. Drop-in sessions are non-refundable. To reschedule or cancel a Therapy session, the User must send an email to hei@cope.no.

Deleting user account

You can delete your user account at any time. If you delete your user account, your personal and health information related to your previous treatment will still be stored in our patient record, according to Norwegian law. You still retain all rights under the health and privacy laws.

Updates and changes

Cope reserves the right to make changes to the Service. Important changes to our products or terms will be announced on the Cope website and/or app.

The current terms will be available in the app and on our websites at any time. If these terms are not accepted by the User, it is the responsibility of the User to delete the user account.

Complaints

If you wish to send a complaint about the Service, you can contact us directly at hei@cope.no. If so, please email us with a full description of the complaint or issue.

Current laws

Norwegian law applies to these terms. By using the Service, you consent to the jurisdiction of the Norwegian courts and waive the right to claim inappropriate venue.

Guidelines for Cope’s privacy policy.

Cope is provided by Coperiosenteret AS ("Cope" or "vi"). This Privacy Statement contains information on the processing of health and personal information related to the health services provided through the Cope website, application, and digital meetings and products sold on the Platform (hereinafter referred to as the "Service"). The user of the Service is hereinafter referred to as "User" or "you". For information on our general terms and conditions, please refer to our Terms and Conditions.

Cope and its health care professionals are responsible for the personal information that is processed in connection with the Service. If you have any questions about the Privacy Statement, please contact us through hei@cope.no.

Information collected automatically

Cope's Service can automatically obtain the following information

The IP address of the device you use and the URL of the page you came from and move on to after the Service.

Information about transactions that you make using the Service.

What we use the information for

The information collected is used to develop, improve and protect the Service, ensure the functionality and security of the Service, administer the Service, be able to communicate and optimize the Service to the user, as well as prevent and detect fraud and other abuse of the Service.

We do not sell, rent or otherwise disclose personal information related to our registered users to third parties, unless it is;

payment processors and data storage providers, which enable us to offer you the Service,

or public authorities if we are legally obligated to do so or if we must protect our rights or the rights of third parties.

Your rights

You have the right to know what information we have about you: If you want to know what personal information about you we store or have stored, please contact us at hei@cope.no

You also have the right to have incomplete and incorrect personal information corrected, deleted or updated. You can do this yourself by logging into your user account or by contacting hei@cope.no

Data security

Your safety is very important to us. We comply with the Privacy Policy and have established rules and procedures to protect your information. All data is encrypted and stored in Microsoft Azure, which is approved by the Norwegian authorities for storing health data for Norwegian residents. Sensitive information is not available to anyone but the psychologist and User.

The journal itself is kept in its own subject system (Psykbase). This is the same system used for offline therapy at CoperioSenteret AS. Thus, medical information is not stored in the system that provides the digital sessions.

Transfer of Personal Data Abroad

All personal data and sensitive personal data are operated by servers located in the EU/EEA. Personal data and sensitive personal data will never be operated by servers located outside the EU/EEA.

Changes to the Privacy Policy

Occasionally, we may make changes to our Privacy Policy. You can see that privacy policy changes have been made by looking under “Last Updated” at the bottom of the page.

Storing and deleting personal data

The personal information will not be stored any longer than is necessary to achieve the purpose of Cope's Service.
